medical cannabis takes another step forward in Congress

The patients who use cannabis for the treatment of their ailments received good news after the Health Commission of the Chamber of Deputies approved the bill that seeks to regulate the medicinal use of marijuana and prevent these users from facing a judicial process or, even, the jail.

Although the initiative had already been approved in general by the Chamber of the Chamber, it had to return to analysis to the Health commission due to the presentation of a series of indications, most of which were dismissed, therefore, the initially approved text was kept without major modifications.

In particular, the parliamentary group analyzed eight indications of which only were approved the one that specifies the quality of surgeon “dealer”, in the case of the professional who will prescribe treatment with cannabis-derived products; and another that change the concept of “medical document” for that of “medical prescription”.

With these changes, the project -which seeks to add a single article to the Sanitary Code- states that “in the case of the manufacture of products derived from species, subspecies and varieties of the genus cannabis, intended for the care of medical treatment, must be prescribed by a treating surgeon, through the corresponding extended prescription according to the provisions of the law and in the (future) regulation. This medical prescription must also indicate diagnosis of the disease, its corresponding treatment and the form of administration of cannabis, which in no case may be by combustion”.

It also states that the aforementioned prescription will constitute sufficient authorization -with respect to the established in the article 8 of the law 20.000, indicating the severe penalties for growing cannabis plants- when specifying the required dose, the duration of the treatment, and corresponds to any of the diseases that can be treated by these products”.

Finally, It specifies that it will be the responsibility of the treating physician to base his diagnosis on the relevance of the treatment indicated in the prescription and that natural products derived from cannabis will not be considered counterfeit, provided that its use is prescribed for medicinal purposes.
